BATTLEFRONT.CO.UK – USER TERMS AND CONDITIONS

By registering with, using or visiting the battlefront.co.uk website (the “Site”) you agree to these terms and conditions (“Terms”) and our Privacy Policy (which is incorporated into the Terms). If you do not agree to the terms or Privacy Policy, please do not use or register with the Site.

The Site is owned and operated by Raw TV Limited (“Raw TV”) and Channel Four Television Corporation (“Channel 4”) and is part of a Channel 4 Education project known as “Battlefront” (the “Project”) which is produced by Raw TV under commission from Channel 4. Raw TV and Channel 4 are collectively referred to in these terms as “we”, “us” and “our”. Please read the Terms (and other terms set out below) carefully as they set out your rights and obligations and the terms on which we make the Site available to you. They also provide information on how you can submit material and how this will be used and the rules for any Competitions held on the Site.

IMPORTANT NOTICE ABOUT USER CONTENT

By providing content to us or the Site you confirm this is (a) your own work and not copied from anyone else or infringing of any third party’s rights and (b) not defamatory, harassing, obscene, offensive, threatening or in breach of anyone’s privacy. You must have the consent of anyone featured in the content to provide this to us. Any Comments posted by the Site must comply with the House Rules (Section 10)

You will own any original content you provide (except as otherwise set out on the Site) but by providing content you agree we may use it, copy it and make any part of it available on the Site, other internet sites, mobile, television, radio and/or any other media channel in any format. Further details are set out below.

Specific rules apply to Competitions and voting. Please see section 11 for more details.

The Site may contain content created by user submission and which does not necessarily represent the views of Raw TV or Channel 4. If you wish to make a complaint about any content please contact us in accordance with Section 12 below.

IF WE DISCOVER OR HAVE ANY REASON TO SUSPECT YOU HAVE BREACHED THE TERMS WE RESERVE THE RIGHT TO SUSPEND OR TERMINATE YOUR MEMBERSHIP OF THE SITE IMMEDIATELY AND WITHOUT NOTICE.

  1. YOUR OBLIGATIONS AND THE TERMS

    If you would like to upload material to the Site, interact with the Site or become a Campaigner (see Section 4 below) you must register on the Site. As part of this you will be asked to “accept” the Terms and, on doing so, you will be deemed to have consented to and will be bound by the Terms. You must register with the Site before you can run your Campaign (see Section 4 below) on the Site and you may be required to register in order to submit User Content (as defined below) e.g. comments, to the Site.

    Other visitors to the Site do not need to register with the Site. However, any use of the Site (including, but not limited to, viewing content) constitutes your acceptance of the Terms, which takes effect the moment you first use the Site. If the Terms are not accepted in full, you do not have permission to access the Site and should stop using it immediately.

    We reserve the right to change the Terms at any time by posting changes online and it is your responsibility to refer to and comply with the most up to date Terms on accessing the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the Terms as modified.

  2. AGE OF CONSENT AND OTHER ELIGIBILITY REQUIREMENTS

    To register with the Site and to become a Campaigner or otherwise to submit User Content you must be over the age of 18 (unless you have parental consent (or in respect of Competitions you must be over 18 unless you have parental consent). Except where the Site otherwise provides children and young people under 18 are entitled to access the Site and view content but we do not give permission for them to register without the permission of a parent or guardian or actively participate in the Project eg. to become a Campaigner or upload User Content. Except where the Site provides otherwise, you should not attempt to do any of these things if you are under 18 (or allow anyone else to do so).

    Where there are any other restrictions or eligibility requirements these will be set out on the Site (or in respect of Competitions are set out in Section 11 below – you must be located in the United Kingdom to enter a Competition).

    You understand content on the Site may contain material that you may consider offensive or otherwise objectionable. You agree that neither Raw TV nor Channel 4 will have any liability to you for any content that may be found to be offensive or otherwise objectionable.

    We reserve the right to ask for written proof of age or eligibility from you. If we discover or suspect that you do not comply with the age requirements or are otherwise not eligible, we reserve the right to suspend or terminate your Campaign or use of the Site immediately without notice.

  3. YOUR PASSWORD, USERNAME AND SECURITY

    Where you register to run your own campaign (a “Campaign”) on the Site (see Section 4 below) and to become a “Campaigner” you will be asked to select a user name and password you can then use to access your account and log on to the Site to manage your Campaign. We reserve the right to reject user names that are offensive, defamatory or otherwise unsuitable.

    Once registered you will be able to update certain details via your account and you will be able to set your Campaign profile and upload any User Content (as defined below) to your Campaign .

    You accept it is your sole responsibility to maintain the confidentiality of your password and you are responsible for all activity that occurs under this. We are unable to check the identity of people acting as Campaigners and will not be liable where your password is used by someone else. You should make sure you are the only person using your password and you agree to notify us immediately of any unauthorised use of your password and any other breach of security as soon as you become aware of it.

    If you use any functionality that we make available that allows people to contact you or leave comments, you accept these may be abusive, untrue or unpleasant. Please be careful when using any messaging and do not reveal personal information such as your home or work contact details, your last name or where you live. You can use the complaints procedure if any issues arise (see Section 12 below). The Site will explain any functionality that we introduce to allow you to block or remove comments.

  4. GETTING INVOLVED – RUNNING YOUR CAMPAIGN ON THE SITE

    If you want to get involved in the Project and run and manage your own Campaign on the Site, the details of how to do this are set out on the Site, including the process and any additional rules or requirements which you and your Campaign must comply with (“Campaign Requirements”).

    You will need to register on the Site to run and manage your Campaign on the Site. You will be able to create a profile for your Campaign and to upload your User Content relating to your Campaign to your profile. User Content and Your Data supplied by you as part of the registration process to become a Campaigner and as part of your Campaign MUST comply with these Terms and the other requirements we notify to you and will be used as set out in Sections 5 and 8 below.

    We reserve the right to reject any incomplete Campaigner registration and/or remove or amend any Campaigns that that do not follow the Campaign Requirements or the Terms.

    We may withdraw, cancel or amend any Campaign registration process without prior notice if the Project is cancelled, to ensure compliance with legal, regulatory or other similar requirements or for any reason outside our control. Any changes will be posted on the Site.

  5. HOW WILL WE USE YOUR MATERIAL

    “User Generated Content” (referred to in the Terms as “User Content”) includes all content provided to the Site or to us or uploaded to the Site by users (including, but not in limitation, by users as part of their Campaigns) i.e. videos, clips, pictures, reviews, comments, data posting, Competition Entries and all other user generated material.

    You agree and guarantee that any User Content you provide or upload is original to you and does not infringe the copyright or any other rights of any person. You must obtain any consents necessary for you to provide the User Content to us.

    We do not, unless we agree this with you, claim any rights of ownership in your User Content. As such, you will retain all ownership rights and, although we will be able to use the User Content as set out in these Terms, you will also be have the right to use your User Content in any way you choose. Where User Content is to be used in a different way (e.g. we are asking to own this) this will be made clear on the Site and you will then be able to choose whether to provide particular User Content on that basis.

    Where we do not own User Content, you agree that we (and third parties authorised by us) may make any and all User Content available on the Site and any other media, whether now known or invented in the future, which may include other internet sites, mobile, television and/or radio and that User Content may be made available with advertising and/or sponsorship. You now grant us (and third parties authorised by us) a non-exclusive, worldwide, royalty free, irrevocable licence (for the full period of any rights in the User Content) to use, display, publish, broadcast, transmit, copy, make derivative works from, issue copies to the public, communicate to the public by way of electronic transmission, perform, show, play, edit, adapt, alter, store, re-format, sell and sub-licence the User Content without further liability or acknowledgement to you (and you also give us all necessary consents and waivers, including without limitation waivers of any moral rights of authors) for such purposes.

    Whether or not we own User Content, you grant us (and third parties authorised by us) the right to issue publicity concerning the User Content and any material, service or programme in which it may be included, and for such purpose to use and reproduce your name and photograph (where these have been provided to us) and your User Content.

    We do not guarantee to use or otherwise make available User Content. Any User Content may be rejected by us and may be edited, moderated or deleted at our absolute discretion. We reserve the right not to accept User Content that is not in English and cannot be moderated. All decisions are final and neither Raw TV nor Channel 4 will enter into any discussions or correspondence about why User Content has been rejected.

    We may, in appropriate circumstances, and at our sole discretion, remove or disable access to User Content that appears to be legally or otherwise problematic e.g. it infringes the copyright or other intellectual property or privacy rights of others, is defamatory, offensive etc. or for any other reason. In relation to all reviews and comments posted on the Site, you consent to us editing such reviews to ensure compliance with the Terms.

    We do not keep any “comments” that are not accepted for publication but may retain other User Content even if this is not published. You agree, however, that we have no obligation to keep originals or copies of any User Content or to return this to you or remove this from the Site on termination or at the end of your Campaign or otherwise.

  6. YOU PROMISE:

    You agree and confirm that:

    A. if registering to participate in the Project (e.g. to run and manage your Campaign on the Site) that you are the appropriate age set out in Section 2 (or you are the appropriate age provided for on the Site);

    B. all information provided by you to us is accurate, true and up to date in all respects and at all times, all facts expressed by you in User Content are true to the best of your knowledge and belief and, if your User Content contains opinions, these are your own and genuinely and truly held by you;

    C. all User Content is original to you and you are fully entitled (and have all necessary consents) to give the User Content to us (you must also have the consent of anyone featured in the User Content to provide this to us) and you are happy for this to be used as set out in the Terms;

    D. nothing in the User Content will infringe the copyright or any other right of any person, breach any contract or duty of confidence, be defamatory, obscene, offensive, indecent, harassing, threatening, breach anyone’s privacy or may constitute a contempt of court or be calculated to bring any broadcaster or other person into disrepute;

    E. all User Content will comply with any additional terms or requirements on the Site and you will at all times comply with the Terms; and

    F. you will only use the Site for lawful purposes as intended and will not spam or hack or attempt to disable the Site or attempt to gain unauthorized access to the Site.

    You agree to indemnify and keep indemnified Raw TV and Channel 4 from and against all claims, damages, expenses, costs and liabilities (including legal fees) relating to or arising from your use of the Site and/or your User Content or arising from any breach or suspected breach of the Terms by you or your violation of any law or the rights of any third party.

  7. OTHER SITE TERMS

    Some parts of the Site may have specific terms of use. By registering for and/or using these parts of the Site you are agreeing to these specific terms. If there is any conflict between the Terms and specific terms appearing on the Site, the specific terms shall prevail.

  8. YOUR PERSONAL DATA

    Personal information you are asked to supply or you supply voluntarily as part of the registration, upload/download process and any other information relating to your User Content (e.g. information provided to us in relation to legal and best practice issues) (“Your Data”), will be used by Raw TV, Channel 4, Raw TV and Channel 4’s group companies, service providers and other organisations and by their subcontractors, employees, agents and advisors (including legal advisors) as follows: (i) to administer your Campaign; (ii) in making decisions about whether User Content you seek to upload onto the Site should be accepted, rejected or used; and/or (iii) to assess your Competition Entry; and/or (iv) as set out on the Site or the Terms. In addition, we may at our discretion disclose this information to the police, regulatory bodies or any legal advisers in connection with any alleged criminal offence or suspected breach of the Terms by you or otherwise where required by law.

    You may be requested to take part in promotional activity and we reserve the right to use your details, photographs and audio and/or visual recordings in any publicity (including as set out in Section 5).

    Your Data supplied as part of your Campaign User Content will, unless we tell you otherwise, be able to be seen by other users of the Site so make sure you only provide information you are happy to be seen in this way. You can control some of the information other users see using your “profile” page.

    Except as set out above (or where we agree otherwise with you e.g. in relation to contacting you for marketing), Your Data will be kept private and confidential, will not be passed on to third parties without your express consent and will be used in accordance with our Privacy Policy. By becoming a Campaigner and/or using the Site you are agreeing to Your Data being used as set out above.

  9. USE OF THE SITE

    In accessing the Site, you agree to do so only for your own personal, non-commercial use and in accordance with the Terms. Unless otherwise stated, you may not copy, reproduce, download, post, store (including in any other website), distribute, transmit, broadcast, commercially exploit or modify in any way the Site’s material or content (including User Content) or permit or assist any third party to do the same.

    You agree to only use the Site for lawful purposes, in a manner which does not improperly infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by any third party. Such restriction or inhibition includes, but is not limited to, conduct which is libellous, in breach of anyone’s privacy or which may harass, cause real distress or inconvenience to any person and the transmission of obscene or offensive content or interruption of the normal flow of dialogue within the Site.

    Content (including User Content) may be made available with advertising or sponsorship. Your obligations in relation to this are the same as the content to which these adverts or sponsorship relate.

    Any copying, reproduction, lending or hiring, public performance, broadcasting or any other form of distribution of Site, and/or User Content (including peer to peer transfers) other than in accordance with these Terms is prohibited and will constitute a copyright infringement.

  10. HOUSE RULES – POSTING COMMENTS ON THE SITE

    If you post a comment on battlefront.co.uk it must comply with these Terms and in particular this Section 10 (House Rules). If you’re unclear about any of them, ask us a question at [email protected] or www.channel4.com/help. If you disagree with the guidelines, we’re always open to feedback but please note, if your comment doesn’t comply it will be removed and you might even find your account suspended.

    We moderate all community areas on the Site on a post-moderated basis. This means one of the moderation team will review your comment after your comment is published. If they find something that breaks these House Rules or any other part of the Terms, your comment(s) will be removed.

    Please be aware that we have the right to remove any comment that we feel necessary to maintain a pleasant and constructive community tone. If you think you have been banned, contact [email protected]. Do not register a new name as that will lengthen any ban.

    The following rules are applicable across Battlefront communities. You should:

    RELEVANCY: Make sure your comment is relevant to the content. Off-topic comments will be removed, unless it’s a designated off-topic area.

    REPORT: Use the report button if you think a moderator needs to check the comment for any reason. If you think someone is misusing the community and attack back, your own account could be suspended; so don’t retort, hit report!

    ENJOY: Try to have fun. If you find yourself getting wound up or stressed take a break for a bit - coming back refreshed and eager to throw your wit at us once more.

    EMPATHISE: Be patient with other users. Even if someone posts in a way that annoys you (in txt spk for example), stay polite and light-hearted in any response. (In 10 years they might be your doctor, or Member of Parliament.)

    Contact [email protected] if you have any questions or problems using Battlefront communities. Replies may take up to a week when things are busy.

    Make sure you don’t: (Breaking these rules may result in your suspension)

    BAD LANGUAGE: No swearing of any kind is allowed in Battlefront Communities (even with *s!).

    OFFENSIVE BEHAVIOUR: Don’t post in a manner likely to offend users, disrupt the community or just, in general, be mean.

    THEFT: Don’t copy and paste large chunks from other sites or include copyrighted material in your post.

    VIRUS RISK: Don’t link to any kind of media or executable file directly. If you suspect someone has attempted to post one, DO NOT open it. Please note neither Raw TV nor Channel 4 is responsible for third party sites.

    BICKERING: Don’t get into personal arguments with other users. We do not allow the abuse of other commenters. If another user is attempting to get into an argument with you please do not rise to the bait. Use the report button (present on the bottom of every comment) rather than getting into personal attacks.

    SAFETY: Don’t give out any personal information about yourself or another person, especially contact information. You may think you know the people you are chatting to, but you do not know the many thousands of casual guests who can read what you post.

    CONFIDENTIALITY: Be aware that copying an email that has been sent to you by either an individual or a company may break the confidentially terms between you and the sender, which can be found in the footer of the email. These posts will be removed.

    ILLEGAL: Do not include anything that is obscene, indecent, harassing, threatening or offensive or that promotes cruelty, violence, vandalism, fraudulent or criminal acts or anything that could encourage others to commit illegal acts or acts that could cause physical harm if replicated.

    LIES & COURT CASES: Do Not say untrue things about people or companies as this may be defamatory and don’t mention any court cases or arrests as this may constitute a contempt of court.

    SPAM: Don’t try to promote your website, business, dodgy money making scheme, hamster breeding farm or your lonely single self.

    DELETED COMMENTS: Do not repeatedly re-post deleted topics or comments.

    FOREIGN LANGUAGE: Messages may be removed if posted in languages other than English.

    LINKS: You can link to any website to illustrate your comment so long as it is not:

    • Commercially motivated
    • A link to content the breaches copyright
    • A direct link to a media or executable file, e.g. wmv, mp4, mov, mp3, pdf
    • A link to obscene or unlawful content
    • Considered spam or off-topic

    If you are a blogger, you may add a link to your blog in the ‘url’ field where available. Please note neither Raw TV nor Channel 4 is responsible for the content of 3rd party sites.

  11. COMPETITIONS

    This Section together with any specific rules set out in Competition Notices (as defined below) are the Competition Rules (“Competition Rules”) and apply to competitions on the Site (each a “Competition”). By entering a Competition, entrants agree to be bound by these Rules:

    A. Competitions on the Site are organised by Raw TV and Channel 4. Rules specific to each Competition are displayed in a notice on the page for such Competition (“Competition Notice”) and are incorporated into these Competition Rules. In the event of differences or discrepancy between this Section 11 and the Competition Notice, the Competition Notice shall prevail.

    B. We reserve the right to cancel or amend the Competition or the Competition Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation, or any other event outside our reasonable control or otherwise for legal compliance or administrative reasons (as determined by us). Any changes will be posted either within these Terms or the Competition Notice. A copy of the Competition Rules may also be obtained by sending a stamped addressed envelope to: Battlefront Competition Rules, Raw TV, 2nd floor, Solecast House, 13-27 Brunswick Place, London, N1 6DX..

    C. In the event of any dispute regarding the Competition Rules, conduct, results and all other matters relating to a Competition, our decision shall be final and no correspondence or discussion shall be entered into.

    D. Qualifying Entrants

    Employees (or members of the families or households of employees) of Raw TV, Channel 4 or any company involved in the Competition or the Project, or any advertising agency or web company connected with the Competition or Project or any such person’s subsidiary or associated companies, are not eligible to enter the Competition. We reserve the right not to award a prize (and to select an alterative winner) if we become aware or have reasonable grounds to believe that a winner is not eligible.

    Additional eligibility requirements may apply to a specific Competition, e.g. a valid passport, visas and/or driver’s licence will be required if the Competition prize includes travel outside the United Kingdom and/or car hire. These will be set out in the Competition Notice.

    By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. We reserve the right to verify the eligibility of all entrants.

    The address you provide with your competition entry (“Entry”) will be used to send any prizes so please make sure this is correct. Competitions are only open to residents of the United Kingdom and you are not entitled to enter the Competition if you are resident outside of the United Kingdom.

    Where a Competition is open to all age groups, we assume that by using the website and entering the Competition (and you warrant that) you are aged 18 or over or, if you are under 18, that your parents have consented to your entry into the Competition and these Rules. If a Competition is only open to a certain age group (e.g. 18 and over), this will be set out in the Competition Notice and we assume that by entering the Competition (and you warrant that) you are the appropriate age to enter the Competition.

    We reserve the right to disqualify any entrant if we have reasonable grounds to believe the entrant has breached any of the Rules.

    In the event that any entrant is disqualified from the Competition, we may in our sole discretion decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Competition Rules.

    E.Competition Entries

    Unless stated otherwise in the Competition Notice, you may enter the Competition as many times as you like however where a winner has been selected and we discover or have reasonable grounds to believe the winner has used any software or automated process either to answer questions or to make bulk entries, we may select an alternative winner. Any further winner will be selected on the same criteria as the original winner and will be subject to these Competition Rules.

    Competition entries must be made in the manner and by the closing date and time specified on the Competition Notice. Failure to do so will disqualify the entry.

    There is no purchase requirement to enter a Competition and there is no charge to register for use of the Site.

    Proof of posting or emailing cannot be accepted as proof of delivery. We cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to Entries, or Entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside our control.

    Entrants should note that unless stated otherwise, we do not accept responsibility for the return of any Entries, including those consisting of artistic or other material.

    F. Prizes

    Unless stated otherwise in the Competition Notice, prize winners will be chosen at random from all correct Entries (for competitions involving answering questions or where entry is by emailing or otherwise providing a name and/or contact details to us) or from all submitted entries (where creative or artistic merit or other subjective criteria apply to entries (unless these are being judged as set out in the Competition Notice)), within 28 days of the closing date specified in the Competition Notice. Tie-breakers will be judged by Raw TV and Channel 4 and, if required by law, by an independent adjudicator. In all matters, the decision of the judge(s), Raw TV and Channel 4 shall be final and no correspondence or discussion shall be entered into.

    Prize winners will be notified in the manner and within the time specified on the Competition Notice (and may be contacted by us or our nominated supplier(s)). Return of any prize notification as undeliverable or failure to reply as specified in the notification (and within the time stated) may result in disqualification and selection of an alternate winner. If more than one prize is awarded only one prize per entrant will be awarded. Competition winner(s)’ names may be published on the website or you can write to Battlefront Competition Prize Winners, Raw TV, 2nd floor, Solecast House, 13-27 Brunswick Place, London, N1 6DX naming the specific competition including a self-addressed stamped envelope for a list of winners.

    Claims for prizes must be made in the manner and within the time specified on the Competition Notice. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.

    Prizes are non-transferable and there is no cash alternative. We reserve the right to substitute prizes of equal or greater value at any time.

    Prizes are awarded at our discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant. Where Entries are being judged on creative or artistic merit or other subjective criteria, Raw TV, Channel 4 and/or the Competition judges (acting reasonably) reserve the right not to select a winner, and/or to remove or amend selection criteria and/or the structure and operation of the Competition if Entries are not of the requisite standard.

    Where a prize may not be appropriate for a younger contestant, the minimum age for entry will be stated in the Competition Notice and must be observed. We reserve the right to request written proof of age of any winner.

    All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses upgrades etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner.

    G. Intellectual Property Rights & Use of Entries

    We do not, unless we agree this with you, claim any rights of ownership in your Entry. As such, you retain ownership of your Entry and, although Channel 4 will be able to use Entries as set out in these Terms (see Section 5 (How we will use your material) above), you will also have the right to use your Entry in any way you choose. Where any Entry is to be used in a different way (e.g. we are asking to own this) this will be made clear on the Site and you will then be able to choose whether to enter the Competition. If you win a prize, as a condition to receipt of that prize, you may be required to sign a release form (in Raw TV’s or Channel 4’s then current standard form) in connection with the prize-winning submission.

    In consideration of Raw TV and Channel 4 agreeing to consider entrants to the Competition, each entrant hereby agrees that Channel 4 (and third parties authorised by Channel 4) may make any and all Entries (which shall be considered User Content under these Terms) available on the Site and any other media in accordance with Section 5 (How we will use your material) above.

    We do not guarantee to use or otherwise make available any Entry. We may also, in appropriate circumstances, and at our sole discretion, reject, edit, remove or disable access to Entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory, are offensive etc. or for any other reason.

    Your Entry and any information submitted by you must be personal to and relate specifically to you. You hereby warrant that your Entry and all information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, offensive, obscene, indecent, harassing or threatening. If relevant, we reserve the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.

    H. Voting

    Some Competitions may invite members of the public to vote (a “Vote”) to select finalists or winners of a Competition by using a “Vote” button on the Site next to individual Entries. Details of the Vote will be set out in the Competition Notice. If you participate in a Vote the requirements set out in the Competition Notice and the following voting rules (together the “Voting Rules”) apply (and by voting you agree to be bound by these Voting Rules):

    You may cast your vote online by selecting the Entry you wish to vote for (using the “vote” button” and entering your name and email address when prompted and clicking submit.

    You are only permitted to vote once per email address. Multiple votes from the same email address will be counted as one and only the first vote cast will be valid.

    The Vote will close on the date and time set out in the Competition Notice.

    We reserve the right to discount votes if we have reasonable grounds to suspect that fraudulent bulk votes have been cast. This includes, but is not limited to, more votes being cast than a human being could possibly submit in the time available without the use of software or other devices designed to make or facilitate automated votes.

    We reserve the right to discount votes cast from an invalid email address or any address that causes us to doubt the propriety of an email address.

    We may suspend, withdraw, cancel or re-set the Vote for any reason at its sole discretion and at any time.

    We reserve the right to revert to using a panel of judges to decide the finalist and/or winner(s) (as applicable) if we have any reason to doubt the validity of the vote result.

    In the event of a tie the placings of the finalist and/or winning Entry/Entries will be decided by a panel of judges at Raw TV and Channel 4.

    Our decision in respect of the votes is final.

    Raw TV and Channel 4, their group companies and sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem in any system, server, provider or otherwise which may result in any vote being lost or not properly registered or recorded. To the fullest extent permitted by law, Raw TV and Channel 4 hereby exclude all warranties, representations, covenants and liability (whether express or implied) regarding the Vote.

    Any personal data collected will be used in accordance with Section 8 (Your Data) above and our Privacy Policy.

    We reserve the right to amend these Voting Rules without prior notice. Any changes will be posted on this website and such posting shall be adequate notice to all participants.

    I. Neither Raw TV nor Channel 4 can accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize. We are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude Raw TV or Channel 4’s liability for death or personal injury as a result of its negligence.

    J. Winners may be requested to take part in promotional activity and we reserve the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity. Any personal data relating to entrants will be used in accordance with Section 8 (Your Data) above.

  12. OTHER USER CONTENT, COMPLAINTS AND CONTACTING US

    Although we ask all users to submit User Content that complies with the Terms, you acknowledge that User Content supplied by other users (including but not in limitation, user Campaigns) may include material you consider offensive or objectionable. We assume no responsibility or liability for User Content and, as the User Content is created by users, it does not necessarily represent the views of Raw TV or Channel 4.

    If you become aware of any misuse of the Site or wish to complain about any User Content or other material on the Site or believe any of your rights have been violated e.g. your copyright infringed, you have been defamed etc., you can use the Report button next to each item of Content or you can contact us via the contact details set out below (see Section 18). If you contact us we will need to know:

    Nature of your complaint and location within the Site of the particular content or user.

    For copyright disputes, identification of the copyrighted work you claim has been infringed and a statement that you have a good-faith belief the disputed use is not authorised by the copyright owner, its agent, or the law and that you are the owner of the copyright interest involved or are authorised to act on behalf of the owner.

    Your name, address, telephone number and email address and such other information as we may reasonably request. We may, but are not obliged to, monitor or assist in disputes between users. You are solely responsible for your interaction with other users.

  13. TERMINATION AND SUSPENSION

    We reserve the right to modify, suspend or discontinue the Site or any part of it (including the availability of any features of the Site or pages on the Site) at any time and without notice or liability to you. We are also entitled to suspend or terminate your Campaign or access to any part of the Site at any time if you breach the Terms or for technical reasons.

    You may terminate your Campaign at any time, for any reason, by following the instructions in your profile or within your account. Even after your Campaign is terminated (for whatever reason) the Terms will remain in full force and effect. Your User Content will remain on the Site - please contact us via the Contact details set out in Section 18 below with details of any User Content you would like to be removed and we will try to remove this.

  14. THIRD PARTY SITES/LINKS

    Neither Raw TV nor Channel 4 are responsible for the availability or content of any third party websites or material you access through the Site. If you decide to visit any linked site, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or other destructive elements. Raw TV and Channel 4 do not endorse and are not responsible or liable for any content, advertising, products, services or information on or available from third party websites or material (including payment for and delivery of such products or services) or for any damage, loss or offence caused by or, in connection with, the same. Any terms, conditions, warranties or representations associated with such dealings, are solely between you and the relevant provider of the service.

    You may link to your own User Content on the Site or send links to other people’s User Content on the Site via email. Other than this, links to the Site must be clear links to the relevant page on battlefront.co.uk and content must not be viewed within the pages of any other site (unless expressly set out otherwise on the Site) such that content does not appear to come from us. Raw TV and Channel 4 disclaim all liability for any legal or other consequences (including for infringement of third party rights) of links made to the Site.

    Links do not imply that Raw TV or Channel 4 endorses, is affiliated or associated with any linked site, or is legally authorised to use any trademark, trade name, logo or copyright symbol displayed in or accessible through the links, or that any linked site is authorised to use any trademark, trade name, logo or copyright symbol of Raw TV or Channel 4 or any of their affiliates or subsidiaries. Raw TV and Channel 4 reserve the right to request that any links are removed at any time and you agree to comply with any such request.

  15. DISCLAIMER/LIMITATION OF LIABILITY

    The Site, User Content and information, images, logos and content relating to the Site, Raw TV, Channel 4, and/or any of Raw TV or Channel 4’s associated companies, products and services (or to third party products and services), are provided ‘AS IS’ and on an ‘AS AVAILABLE’ basis without any representation, endorsement or warranty of any kind, including but not limited to implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and/or accuracy.

    We will endeavour to provide the Site using all reasonable care and will use reasonable efforts to make the Site available to you at all times during the Project. However you acknowledge that the Site is provided over the internet and so the quality and availability of the Site (and this reference includes content on the Site) may be affected by factors that are outside our reasonable control such as technical faults in your ISP’s and/or telecommunication providers’ networks/services. Neither Raw TV nor Channel 4 are responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, providers, computer equipment or software, or failure of any email or User Content to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any website (or any combination of these things).

    We make no guarantees that the Site will be available, uninterrupted or error free, or that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs. Except as required by law, neither Raw TV nor Channel 4 will be responsible for any loss or damage caused by: (a) interruption or delay to the Site or errors, viruses or bugs contained in the Site caused by events outside our reasonable control; (b) your negligence, your breach of the Terms or failure to follow our reasonable instructions; (c) any incompatibility of the Site with any other software or material on your equipment; (d) any unauthorised use of the Site; or (e) any other factor that is outside our reasonable control.

    Content, information and other material on the Site may contain inaccuracies and typographical errors. We do not warrant the accuracy or completeness of these or the reliability of any information displayed or distributed through the Site (including provided through any software). You acknowledge that reliance on any such information shall be at your sole risk. We reserve the right, in our sole discretion, to correct any errors or omissions in any part of the Site and to make changes to the Site and to the materials, products, programs, services, content or prices described in the Site at any time without notice.

    We cannot accept any responsibility for any damage, loss, injury or disappointment suffered though use of the Site, participation in the Project (as a Campaigner or otherwise) or any Competition. In no event will Raw TV, Channel 4 or any of their third party affiliates be liable for any damages whatsoever, whether in action of contract, negligence or other action, including (but not limited to) damages for loss of use of the Site, damage to equipment or other software, or loss of data or profits or for other monetary loss or for any indirect or consequential damages, arising out of or in connection with the use (or inability to use) or performance of the Site or participation in the Project (e.g. running a Campaign in the Site, or entering a Competition). In addition, in no event shall Raw TV, Channel 4 or their licensors or third party affiliates be liable for any unauthorised use of the Site. These exclusions do not apply to death or personal injury caused by Raw TV or Channel 4’s negligence and shall only apply to the extent permitted by law. This does not affect your statutory rights (please see www.consumerdirect.gov.uk for further details).

  16. OUR INTELLECTUAL PROPERTY RIGHTS, PRODUCTS AND SOFTWARE

    The names, images and logos identifying Raw TV, Channel 4, their associated companies or third parties and their products and services are proprietary marks of these parties. Nothing in the Terms shall be construed as conferring any licence or right under any intellectual property right of Raw TV, Channel 4,their associated companies or any other third party unless expressly stated otherwise.

    All copyright, trade marks and other intellectual property rights in the Site (including the design, arrangement and look and feel) and all material, software or content supplied as part of the Site, other than User Content and Your Data (see Sections 5 and 8), shall remain at all times the property of Raw TV, Channel 4, or Raw TV and Channel 4’s licensors and protected by copyright law.

    Any products and/or services on the Site are subject to availability and are available at our sole discretion. Where applicable, all references to our products and services are intended to apply only in the United Kingdom.

    From time to time certain software which is the protected work of Raw TV, Channel 4 or their suppliers may be made available to download from the Site. You are licensed to use the software on a non-exclusive basis only for the purposes for which it is indicated. You may not use the software for any other purpose and may not redistribute, sell, decompile, reverse engineer, disassemble or otherwise deal with the software unless you are specifically advised otherwise.

  17. LAW AND JURISDICTION

    The Terms shall be governed by and construed in accordance with the laws of England. Any disputes arising from the Site or Terms will be decided only by the English courts.

    The Site is only intended to be accessed from the United Kingdom. We make no representation that materials on the Site are appropriate or available for use at other locations and access to them from territories where their contents are illegal is strictly prohibited. If you access the Site outside of the United Kingdom, you are responsible for compliance with all local laws.

    If any of the Terms are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

    We can transfer its rights and obligations under the Terms to any company, firm or person provided this does not affect your rights under the Terms. You may not transfer or assign your rights or obligations under the Terms to anyone else and your Campaign is personal to you.
